What is First Question to Ask At Deposition; NY Medical Malpractice Attorney Gerry Oginski Explains

Why is it important to ask the first key question at a deposition?
Most lawyers typically will begin a question-and-answer session of a witness by asking about their credentials. However, I find it to be much more effective to instead get right to the heart of the case.
Within the first few questions I like to establish liability if possible.
How can you do that? Here is an example. I recently questioned a dentist and it was our claim the dentist removed two permanent teeth rather than two baby teeth. As a result, this child will likely require implants.
“Doctor you did in fact remove two permanent teeth, correct?”
“Yes.”
“Your intention however was to remove this patient’s two baby teeth, correct?”
“Yes.”
“You would agree Doctor that extracting teeth that are not meant to be removed would be a departure from good and accepted dental care, correct?”
“Yes.”
